Version 3
Who we are
buymydeal.com is run by Buy My Deal Inc., Orlando, Florida ("Buy My Deal", "we"). By using the site you agree to these terms. If you create an account, you also confirm that you have read them and our privacy page.
What the site is
buymydeal.com is a video classifieds site. Members post a short video of something they want to sell. Buyers watch it, message the seller on the site, and can make an offer. Where the seller has switched it on and the feature is available, buyers can also place bids during a fixed bidding period that the seller sets up and controls.
Every sale is between the buyer and the seller. Buy My Deal is not a party to any sale, does not own or hold the items, does not hold money, and does not check that items are as described. Where on-site payment is available, the payment goes directly to the seller through the seller's own account with our payment provider, and we receive a service fee from the seller. Features marked "coming soon" or "not yet available" cannot be used; we never pretend a feature works.
Accounts
- You must be 18 or older to create an account.
- Give a real email address and keep your password to yourself. You are responsible for what happens under your account.
- One person per account. Do not create accounts for someone else or to get around a suspension.
- You can delete your account at any time from your account page. Your listings are removed from the site immediately; a copy cached by a visitor's browser expires within one hour. Their video files are deleted within 24 hours, except for a listing held for a deal, as described in the privacy policy.
Video listings
- Only list items you own or are allowed to sell, and describe them honestly, including the price and condition.
- Your video must show the item for sale. Videos are limited to 3 minutes and 500 MB, and every account has a storage limit.
- Do not show other people's faces, license plates, addresses or phone numbers without their permission. We remove location data embedded in uploaded video files, but you are responsible for what the picture and sound show.
- Every listing is checked by a person before it is published, and again after every change. We may refuse, hide or remove a listing, and suspend an account, when we believe it breaks these terms or the law. A listing we hide or remove is removed from the site immediately; a copy cached by a visitor's browser expires within one hour.
- Titles and descriptions may not contain phone numbers, email addresses or street addresses. If you want buyers to call you, enter one US phone number in the contact phone field. By entering it you agree that we show it on your published listing to anyone who presses "Show phone number". You can remove it at any time by editing the listing (the change is checked before it goes live again).
Messages and comments
Signed in members with a confirmed email address can send a private message to a seller about a listing ("Ask the seller") and post public comments on listings.
- Be honest and polite. No threats, harassment, hate, spam, advertising for other sites, or attempts to move a buyer to a payment method our zero fraud policy warns against (gift cards, wire transfers, crypto, "pay first and I ship").
- Messages are text only, up to 2,000 characters. Comments are public, up to 500 characters, and may not contain phone numbers or email addresses; use a private message for contact details.
- A seller can delete comments on their own listings and anyone can delete their own comments. We may hide any message or comment that breaks these terms.
- You can block a member. Neither of you can then send the other a message until the block is lifted.
- Every message has a "Report" button and every comment a "Report" link. We may read a reported conversation: when a member reports a message, our staff can open that conversation to decide what to do, and every such access is recorded in our moderation log. We do not read conversations that nobody reported.
- Following a seller sends you at most one email a day about their new listings. You can turn off each kind of notification email on your email preferences page, and stop emails about one conversation from the link in each email. Emails about your account's security and about changes to these terms are always sent.
Offers
- A buyer can make one open offer per listing. An offer is a serious statement that you will buy the item at that price if the seller accepts; it expires after 72 hours unless the seller decides sooner.
- The seller can accept or decline an offer, and a buyer can withdraw an open offer. When the seller accepts, the listing closes, every other open offer on it is declined, and both of you get a deal page with the next steps.
- Offers that are accepted and then not followed through count against the buyer (see "Deals and strikes").
Bidding
Bidding may not be available yet. When it is, these rules apply.
- The seller decides whether to open bidding on a listing, sets the starting price, an optional reserve (the lowest price the seller will accept), and a bidding period of 1 to 10 days. The seller runs the sale; Buy My Deal provides the tool.
- Once a bid has been placed, the listing and the bidding terms cannot be changed, and the seller cannot end bidding early. Until a bid has been placed, the seller may cancel bidding.
- A bid is a serious statement that you will buy the item at that price if yours is the highest valid bid when bidding ends and the reserve, if any, is met. Bids cannot be withdrawn. Each new bid must beat the current high bid by the minimum step shown on the listing.
- A bid placed in the last two minutes extends the bidding period by two minutes, up to one hour past the original end, so that nobody can win by timing alone.
- When bidding ends, the highest valid bid that meets the reserve is awarded the item, and both buyer and seller get a deal page. If no bid meets the reserve, or there are no bids, the listing simply closes.
- Sellers may not bid on their own listings or arrange for others to bid on their behalf. We log the time and network address of every bid and we remove members who manipulate bidding.
Deals and strikes
- A deal is created when a seller accepts an offer or when bidding ends with a winner. The deal page shows the price, the parties and the next steps. Buyer and seller have 48 hours to pay on the site (where available) or to confirm that they have arranged payment between themselves.
- If a buyer does nothing for 48 hours, the deal expires and the buyer receives a strike. Three strikes end the ability to make offers or bids. A seller may relist the item.
- Confirming "arranged between us" is a statement by the parties, not proof of payment or delivery. Meet in safe public places, inspect the item, and never pay by gift card, wire or cryptocurrency on a stranger's request.
- We may cancel a deal when a listing is removed for breaking these terms, when a member is suspended, or when the law requires it.
Paying on the site
On-site payment may not be available yet. When it is, these rules apply.
- Payment is processed by our payment provider and goes directly to the seller's own account with that provider. The seller is the merchant of record: the seller is responsible for refunds, returns, disputes and any tax, and the seller's name appears on the buyer's receipt and card statement.
- Buy My Deal receives a service fee from the seller on each on-site payment, shown to the seller before the seller connects a payout account. The fee is returned to the seller when a payment is fully refunded.
- On-site payment is not available for vehicles, real estate, land, businesses and other regulated items. Those are advertised on the site; payment and paperwork happen between buyer and seller off the site.
- Sellers must give true information to the payment provider and keep their payout account in good standing. We may stop on-site payment for a listing, a member or the whole site at any time, for example while a problem is investigated.
- A buyer's payment is complete only when the provider confirms it to us. A page shown during checkout is not confirmation.
Items you may not list
- Anything illegal to sell or own in Florida or in the buyer's location, stolen goods, counterfeits and recalled products.
- Firearms, ammunition, explosives, drugs, prescription medicine, tobacco and vaping products, alcohol and live animals other than through a licensed seller.
- Adult content, anything involving minors in a sexual way, hate content and personal data.
- Vehicles, real estate and other items whose sale is regulated may be advertised, but payment and paperwork happen off the site between buyer and seller.
Your content
You keep ownership of the videos and text you post. You give Buy My Deal Inc. a non-exclusive, worldwide, royalty-free license to store, copy, convert, display and share them on buymydeal.com, on buymydeal.tv and in promotion of the site, for as long as the listing is public and for a reasonable time after it is removed. A snapshot of a listing, including its video and photos, is kept for 180 days after a deal so that both parties can refer to what was offered. You confirm you have the rights needed to give this license.
Our content
The site design, the archive videos, the logo and the text are owned by Buy My Deal Inc. or used with permission. Buy My Deal™ and the "bd" mark are trademarks of Buy My Deal Inc.. Do not copy, re-upload or sell them without our written permission.
Using the site
- Do not attack the site, scrape it at a rate that slows it down, or try to reach parts of the server or other members' accounts that are not yours.
- Do not use the site, its messages or its comments to send spam, to defraud anyone or to collect other members' personal information.
Reports and copyright
Every listing page has a "Report this listing" link, and every message and comment can be reported. Copyright owners can use the DMCA page. We review reports and keep a record of what we decided.
No warranty
The site is provided as is. We try to keep it accurate and available but do not promise that it is free of errors or always online, or that any listing, seller or buyer is genuine. Our zero fraud policy describes how we act on fraud; it is a policy, not a promise that fraud cannot happen. To the extent the law allows, we are not liable for losses that come from using the site, from deals between members or from relying on any listing. We are not responsible for a seller's refund, return or delivery obligations, for a buyer's payment to a seller, or for disputes about an item; those are between the parties and, for on-site payments, handled with the payment provider.
Links to other sites
We link to buymydeal.tv, which we also run, and occasionally to other sites. Sites we do not run have their own terms.
Changes and law
We may update these terms. Each version has a number; when a new version is published, members are asked to accept it before they post again. These terms are governed by the laws of the State of Florida.
